Flem K. Whited III
Whited is the name partner in the Whited Law Firm of Daytona Beach, Florida, opened in 1979 . Early in his legal career he was successful in excluding the Smith & Wesson Breathalyzer Model 900A from evidence based on the failure of the local police agency to properly follow manufacture's instructions to detect radio frequency interference. Later he led the challenge to the Intoximeter 3000 breath test machine. He alleged and proved that the machine had been modified from the original version approved by the State of Florida.

Mr. Whited is a member of the Florida Bar Association, the National Association of Criminal Defense Lawyers, and the Florida Association of Criminal Defense Lawyers. He is “av” rated with Martindale-Hubbell and certified as a DUI Specialist by the American Bar Association. Founder of the National College of DUI Defense, Whited has been a speaker at one hundred fifty seminars in over 25 states and four foreign countries.
