Shirley Berger Whitenack
Shirley Berger Whitenack is a partner in the Litigation and Tax, Trusts & Estates Departments at Schenck, Price, Smith & King LLP in Morristown and Paramus, New Jersey. She devotes a substantial portion of her practice to elder and disability planning, guardianships, conservatorships, and trust and estate litigation. Admitted to practice in New Jersey and before the United States District Court for the District of New Jersey and the United States Courts of Appeal for the Third Circuit, Ms. Whitenack is a member of the board of directors of the National Academy of Elder Law Attorneys (NAELA), the Board of Trustees of the New Jersey Institute for Continuing Legal Education (NJICLE), and the Board of Trustees of Guardianship Association of New Jersey, Inc. (GANJI). She is a member of the Special Needs Alliance, an invitation-only alliance of attorneys experienced in special needs planning and counseling, a past chair of the Elder and Disability Law Section of the New Jersey State Bar Association (NJSBA), the Litigation Section and Probate Committee of the American Bar Association, and the Morris County Bar Association’s Estate and Trusts Committee. She also is a member of the NJSBA’s Nominating Committee and the New Jersey State Bar Foundation’s Program Development Committee, serves as the current chair of the NAELA’s Advocacy/Litigation Special Interest Group (SIG) Steering Committee, is a member of NAELA’s Guardianship/Capacity SIG Steering Committee and NAELA’s Annuities Task Force. A frequent lecturer and author for professional and charitable organizations, Ms. Whitenack is a contributing author to New Jersey Elder Law Practice, 3d Ed., published by NJICLE. She has served on the faculty of the Superior Court of New Jersey Judicial College. Ms. Whitenack was selected as a NAELA Fellow, which is the highest honor bestowed by that organization, and is the recipient of NJICLE’s Distinguished Service Award, the NJSBA’s Legislative Service and Amicus Curiae Awards, and GANJI’s Recognition Award. She is AV rated by Martindale-Hubbell and was designated one of the Top 50 Women Super Lawyers and Elder Law Super Lawyers in New Jersey in 2005, 2006, 2007 and 2008 by her peers. Ms. Whitenack is included on the roster of court-approved mediators in New Jersey and participates as a mediator in the Union County Probate Early Settlement Program, as a neutral in the Morris County Probate Settlement Program, and as an arbitrator in Union and Morris County. Ms. Whitenack received her undergraduate degree, cum laude, from the State University of New York at Stony Brook and her J.D., cum laude, from Seton Hall University School of Law, where she was notes & comments editor of the Seton Hall Law Review. She served as law secretary to the Honorable Melvin P. Antell, Superior Court of New Jersey, Appellate Division.
