Drafting Wills and Trust Agreements 7.0 – Update 1 Version 7.1 – February 2010
Highlights
This update to version 7.0 of DWTA implements several clause changes and other various items, such as:
- Federal Estate Tax Repeal — (a) New client letter added discussing the repeal of the federal estate tax and recommending a review of the client's plan (in the Letters dialog under 'User-Defined Letters' select the new user-defined letter "Letter - 2010 Estate Tax Status and Plan Review"); and (b) Minor wording changes implemented for the current clauses addressing federal estate tax repeal (see clauses 8.70, 8.76, 8.76.01, 8.78).
- Supplemental Documents — (a) Bill of Sale document output corrected when entering property descriptions other than the default list items; and (b) Documents (such as the new Personal Information Organizer document introduced in version 7.0) added to the "Produce a Document" list when the client's family status is set to "neither spouse nor children."
- Amendment and Restatement Mirror Image Document — Mirror image restatement document closing provisions modified to output the restatement closing provisions clauses rather than outputting the standard revocable trust closing provisions clauses.
- Share B Clauses — Share B introductory clauses modified to remove stray formatting coding from the document output (see clauses CP.10.30, CP.10.31, CP.10.31.01, T.10.30, T.10.30.01, T.10.31, T.10.32, W.10.47, W.10.47.01, W.10.47.02, W.10.47.03).
- Long-Form Trustee Powers Clauses — Long-form trustee powers clauses modified to correct paragraph number formatting that was causing unwanted article heading numbering within the list of trustee powers (see clauses T.13.60, CP.13.60, I.13.60, I.13.60.01, W.13.60).
- Powers of Attorney Title Page Modification — Title page text for the Durable Power of Attorney documents modified to utilize the document name variable as entered by the user during the document interview rather than outputting "Durable Power of Attorney" in all instances (from the main menu under Other Options, select Set Up System and Document Defaults/Set Up Document Cover Pages and Table of Contents/Table of Contents for Durable Powers of Attorney).
- Michigan Advance Directives — Three new forms added (declaration of anatomical gift, living will, health care power of attorney), adapted with permission from the State Bar of Michigan, Elder Law & Disability Rights Section (see clauses STATE.33.3, STATE.33.4, STATE.33.5).
