Public Records Privacy Policy
West, a Thomson business, uses personal information responsibly and strives to protect privacy rights. All data in the Westlaw public record databases are supplied by government agencies and reputable private suppliers. We do not add personal information collected from individuals to the Westlaw public record databases.
West makes personal information available for legitimate uses by business and government organizations. That means we adhere to the principles in this Public Records Privacy Policy and comply with the requirements of statutes such as the Gramm-Leach-Bliley Act (GLB) and The Driver's Privacy Protection Act. West limits access to non-public and Social Security number (SSN) information, and will terminate access to any user who misuses public records.
Public records on Westlaw are used to identify and clarify relationships among businesses, people and assets. West is not a consumer credit reporting agency. Furthermore, West does not:
  • Permit use of its public records data to compile mailing lists or consumer marketing data
  • Maintain any databases of non-public individual financial data such as individual credit reports, income tax records, employment information or bank information
  • Collect or distribute information about any person's race, religious preference or health
  • Collect any person's medical records
  • Distribute non-public information about people under the age of 18
Definitions
Public records are records that are created and maintained by government agencies and are open for public inspection. Examples include:
  • Real estate records
  • Lawsuit filing records
  • Birth, marriage, and divorce records
  • Motor vehicle data
Nonpublic information is information about an individual obtained from a source that is privately owned and is not available to the general public. Examples include:
  • A person's name, alias names, maiden names or previous married names
  • Current and previous addresses
  • Social Security number
Publicly available information is information about an individual from non-governmental sources that is available to the general public. Sources include:
  • Newspapers and other publications
  • Telephone directories
  • Classified ads
Personal identifying information is information about a person that identifies them or is directly attributed to them. Personal identifying information is contained in public records, non-public information and publicly available information. Examples include:
  • A person's name
  • Address
  • Date of birth
  • Telephone number
Permissible use means that Westlaw subscribers must use public records data for specific, legitimate purposes. These purposes must comply with the Gramm-Leach-Bliley Act and other laws. Examples of permissible uses include:
  • Detecting fraud
  • Locating individuals
  • Engaging in homeland security activities
Nonpublic Information
West does not distribute non-public information to the general public. Only Westlaw subscribers have access to non-public information available through databases like People-Find. Westlaw subscribers include law firms, legal and compliance departments, and government agencies.
Who can access Social Security numbers through Westlaw?
All Westlaw users may search records using a SSN in their possession, but the results of those searches will display masked SSNs. An example of a masked SSN is 987-65-XXXX.
The vast majority of Westlaw users cannot access full SSNs. Only certain government agencies (for example, law enforcement and the Homeland Security Department) may have access to full SSNs. Before they are granted access to SSNs on Westlaw, these agencies must qualify through a review process to have such access.
How does West secure public records and personal information?
West keeps all of our data secure. We take reasonable steps to protect personal identifying Information from unauthorized access. West employees do not have access to full Social Security numbers, except intermittently when required for database maintenance.
Education
West informs our employees and users about appropriate use of its public record products and services. We take measures to educate about:
  • Responsible use of public records, publicly available information and non-public information
  • Privacy issues associated with West's information products and services
  • Information access and the ability to opt-out of our products and services
How does West acquire public records and nonpublic information?
West collects public records and non-public information from established sources in the government and private sectors.
Are West's records accurate?
We take reasonable steps to accurately reproduce data we receive from suppliers. However, sometimes this data may contain errors. If you find an error on Westlaw in a public record or in publicly available information, we'll direct you to the data supplier or government entity that provided that information. If you've found an inaccuracy, send an email message to west.privacypolicy@thomson.com
Can I find out what information West has about me?
Yes. If you are at least 18 years old you may request a statement of the information contained about you in West's public and non-public information databases. To ensure your privacy, we'll ask for information verifying your identity.
To request a statement, complete the Westlaw Personal Information Request Form and return it, along with a $20.00 check or money order and a copy of your driver's license or government issued identification, to:

Please note: the copy of your driver's license or government issued identification will be used only to verify your identity. These copies will be destroyed when the process is complete.

What kind of information is included in the personal information statement?
The personal information statement may include information from public records and non-public sources. The statement will only include information from records referring unambiguously to you.

Can I have my personal identifying information removed?
If you are a judge or public official, believe your personal identifying information exposes you to harm or are a victim of identity theft, you may request removal from Westlaw's non-public information databases. You will need to provide a written explanation substantiating your request. Law enforcement agencies, law firms and compliance departments rely on the accuracy and completeness of these databases, so we consider the merits of each opt-out request carefully.
